The Company will not be liable if, for any reason, the website is unavailable at any time, or for any period of time. 2. USE AND TERMS OF USE OF THE ONLINE STORE

2.2 The use of tbtboutique.com and the services it provides in general, are subject to the terms and conditions set out in this Agreement. Any new services which may be included in tbtboutique.com and may be carried out by it, will be subject to the present TOS, unless the opposite is explicitly stated.

2.3 The use of any of the services provided within the Site (i.e. creation of an account, purchase of product(s), etc), is allowed only to adults over 18 years old, with full legal capacity. In the exceptional circumstance that the product(s) is not available, the Company will make every possible effort to have the product(s) made available. Breach of these Security Rules may lead to civil or penal prosecution. The Company will investigate the incidents which are possibly related to such breaches and may involve and cooperate with the Police Authorities to prosecute the consumers, users and visitors who are related to such breaches.

3. REGISTRATION AND CREATION OF AN ACCOUNT

3.1 It is not necessary to register in order to browse tbtboutique.com, to make a purchase, to make an order or in general to be able to use any of the features of the Site. However, by creating a personal account, you will be able to save your personal data and delivery address(es), so you don’t have to re-enter them every time you place an order. 3.2 By creating an account, you are agreeing to provide true, accurate, current and full information. You are solely responsible for the legitimacy and accuracy of the information you have provided us, and it is your responsibility to keep such information accurate and up to date. The Company cannot and does not confirm, and is not responsible for ensuring the legitimacy or accuracy of any information you have provided. The Company reserves the right to conduct verification and security checks in respect of all information provided by you. 3.3 Once you have registered, you will be asked to confirm your personal password and username. Please be aware that you are fully responsible for all the actions made while using your personal password and username and your account in general. You agree to notify us of any unauthorised use of your account and of any security violation or such possibility that comes to your attention. The Company is not responsible for any harm or damages that may occur from your failure to follow this clause.

3.4 If the Company has reasons to believe that the information provided by you while registering and subsequently using any of our services breaches or is likely to breach any of the provisions set out in these T&Cs, the Company, at its sole discretion, may take any action deemed appropriate to address this breach, including deactivating your account.

3.5 You can request to deactivate or delete your account at any time by sending an e-mail to boutique@thebeautytriangle.com. All information and content that has already been provided to us will be handled according to our Privacy Policy.

3.6 At their sole discretion, the Company reserves the right to suspend or prohibit the use of its services to any user and/or visitor who fail to comply with these T&Cs, including but not limited to: registering using incorrect data, having more than one (1) account, attempting to block the Site in any way. If a user has been banned from using the Site’s services, the user will not be allowed to re-register without the prior written consent of the Company.

4. PERSONAL DATA AND USES

4.1 In order to access some of our services (e.g. creating a personal account, or to sign up to our mailing list, receive newsletters, enter competitions, etc) you may be asked to provide personal data such as: name, surname, email address and a delivery address. This data is needed in order for the Company to be able to communicate with you.

4.2 When making a purchase, you will be asked to provide payment details, such as invoice address, payment method (credit, debit or prepaid card) and card details.

4.3 The Company will treat all personal data entered on its website in a confidential manner and assures that all data will be used in accordance with the applicable UK and European Privacy Laws, and only to the minimum extent necessary and for lawful purposes, such as for the proper function of the online store and its services and for being compliant with the Tax Authorities.

• the disclosure is necessary for the fulfilment of your order (i.e. cooperating transport and courier companies),

• you have given your explicit consent when you click the “I accept” box,

• it is required by Law, by Court Order or Subpoena or requested by any other competent governmental, judicial, police, administrative or regulatory Authority, upon legitimate request and according to the pertinent laws.

5. PRODUCTS FOR SALE

5.1 Products are sold with the characteristics described in the online store and in accordance with the terms and conditions of sale posted on the website at the time of your order, to the exclusion of any other term or condition. The Company reserves the right to change the terms and conditions of sale at any time, at its sole discretion, without prior notice. Any changes will be effective from the date of publishing on the online store and will apply only to sales concluded on or after that date.

5.2 Prices and products for sale as well as their characteristics are subject to change without prior notice. For that reason, before sending your order, you will be asked to verify the final sale price. You may access the online store from all over the world but it may contain references to products that are not available or cannot be purchased from your country. The products for sale differ from country to country and as a result some products may not be available to the delivery country of your choice.

5.3 Purchased products are for personal or gift use and must not be purchased for commercial, business or resale purposes.

6. LIMITATION OF LIABILITY

6.1 The Company endeavours to describe the products on sale as accurately as possible, but cannot guarantee that all descriptions are totally accurate, complete, reliable or error-free. All product images used on the Site are for illustrative purposes only and while efforts are made to display colours as accurately as possible, the Company cannot guarantee how your computer or device will display such colours. As the distributor, the Company is exempt from any liability by only indicating the name of the manufacturer.

6.2 The Company cannot provide any guarantee for the legal capacity of users, consumers and visitors who wish to make a purchase through its online store.

6.3 All users, consumers and visitors must be the lawful owners of the credit/debit/prepaid or any other type of card they use in order to make a purchase on the Site. The Company is not liable against any illegitimate use of such credit, debit, prepaid or other type of card used to make any purchase from the online store.

6.4 The Company is not liable for the security of money transactions. Should any fraudulent activity take place with any of the cards you have used to make a purchase, it is up to you to take it up and resolve with your Bank, in accordance with the respective Bank’s policy,

6.5 The Company has no liability for acts or omissions of third parties, particularly unauthorised third-party interventions in products and/or services and/or information.

6.6 Before placing your order, you are advised to check the materials that the products you wish to buy are made of, as the Company, which is the distributor and not the manufacturer, has no responsibility in case of, included but not limited to, allergic reactions, dermatological diseases and in general any kind of reactions that may occur from the products.

6.7 Every consumer, user and visitor is obliged to exempt, render harmless and relieve the Company from every demand and/or claim of compensation for damage caused by third parties.

6.8 The Company does not have any responsibility for addressing claims of any nature, against third parties, which may have resulted from the use, copy or imitation of the Site or of its contents or any sort of other related websites from third parties which are not authorised by the Company.

6.9 The Company is not responsible for any technical problems that might occur when you attempt to access the website.

6.10 The Company cannot guarantee the continuous and uninterrupted access of the Site and its services, given the possibility of impediment, even in part, due to chance occurrences and/or force majeure. Consequently, there is no responsibility born for the temporary disruption of some sort of service and/or weakness in accessing tbtboutique.com as well as for any possible, direct and indirect, damages and expenses that may occur from the possible disruption to the operation of the provided services that might occur from the causes referred to herein.

6.11 Please be aware that if you have supplied us with an incorrect address, we are not liable for failure of delivery.

7. ORDERS

7.1 To place an order, you must add items to your shopping bag, enter your billing/shipping address, select your delivery option and choose your payment method to complete your order.

All orders are subject to acceptance and availability, and items in your Shopping Bag are not reserved and may be purchased by other customers.

7.2 Once your selection of product(s) is complete, you will be automatically directed to the “Checkout” page, showing a summary (products and prices) of your order. Delivery costs are not included but will be calculated and displayed before the final payment. Prices shown on the Site are in Pounds (GBP) and are inclusive of VAT unless you have selected an alternative country where VAT is not chargeable. Customers from an CCE (Central and Eastern Europe) country on a DDU (Delivery Duty Unpaid) basis will be charged for the items purchased (VAT excluded) and shipping costs only. No taxes or duties will be charged by the Company.

We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion. Payment of these amounts will be necessary to release your order from customs on arrival. Please be aware that some shipments may experience delays due to the customs clearance process, which are outside of our control. If you are shipping outside the UK on a DDP (Delivery Duty Paid) basis, import taxes and duties will be automatically applied at the time of the check out. The costs of shipping and any import taxes and duties paid are non-refundable.

7.3 We are constantly updating and revising our offerings of products, and we may discontinue products at any time, without notice. The pricing of the products for sale is subject to change.

For all of our prices and products, we reserve the right to make adjustments due to market conditions changes, product discontinuation, manufacturer price changes, error in advertisements and other circumstances beyond our control. If the price of an order changes after you have paid for it in full, we will inform you about the correct price, and if it is not accepted by you, your order will be cancelled and a refund will be issued.

7.4 We endeavour to be as accurate as possible with product descriptions and prices, but cannot warrant that product descriptions or prices are accurate. In such an event, the Company will inform you about the correct price or the accurate description of the product(s) and if it is not accepted by you, your order will be cancelled and you will be refunded. If your credit/debit/prepaid card has already been charged and your order has been cancelled for the reasons explained above, the Company will immediately issue a refund to your credit/debit/prepaid card.

If you are not completely satisfied with your purchase, you may return the product/s purchased in accordance with our Return Policy.

7.5 From time to time, prices are subject to change in response to currency exchange rate changes, markdowns and other commercial factors. The price applicable to your order will be the current price, at the time your order is accepted.

8. ACCEPTANCE OF YOUR ORDER

8.1 Once you have placed your order, you will receive an email acknowledging the details of your order. Please be aware that this email is NOT an acceptance of your order, it is just a confirmation that we have received it.

8.2 Acceptance of your order will take place when we email you to confirm your order (order confirmation email). Neither our third-party payment processor nor courier have the authority to accept an order on our behalf. In the event that you do not receive such email within two (2) business days after your order, please contact us at boutique@thebeautytriangle.com

8.3 We reserve the right not to accept your order in the event, for example, that we are unable to obtain payment authorisation, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out in these T&Cs.

9. METHOD OF PAYMENT

9.1 Your payment card will be charged on the same date as the day that you receive the order confirmation email.

9.2 You may pay your order via a credit/debit/prepaid card through the SSL Security and Technology Protocol. Once you submit your credit/debit/prepaid card details you guarantee that you are the lawful owner of the card you use in order to make a purchase from the online store or that you have been specifically authorised to use it by the owner of the credit/debit/prepaid card. All card holders are subject to verification checks and authorisation by the card issuer. If your card issuer refuses to authorise payment to tbtboutique.com, we will not be liable for any delay or non-delivery.

9.3 If you are a registered tbtboutique.com user, we will securely store your card details on our system. These details will be fully encrypted and only used to process card transactions as requested by you. To help ensure that your shopping experience with us is safe, simple and secure we use Secure Socket Layer (SSL) technology. Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.

10. DELIVERY METHOD, TIME AND COST

10.1 Orders are delivered by various couriers depending on the delivery address you have provided. All shipments sent by the Company are insured against theft and accidental damage. Upon receipt of shipment and written acknowledgement, this insurance coverage ceases to exist.

10.2 Unfortunately, we cannot deliver to P.O. boxes.

10.3 Sales taxes, customs duties and handling costs may be charged by the courier (this applies to EU and International countries) and are not refundable.

10.4 Orders are processed and sent during office hours: Monday to Friday, from 10:00 am until 6:00 pm (with the exception of UK public holidays). Orders will be ready for dispatch one business day after the receipt of payment, at the latest. The Company is not responsible for any international shipping delays caused by the customs clearing process.

10.5 If the courier is unable to deliver due to the recipient being away on the designated delivery day, the products are returned either to the transportation or courier company or to the Company’s registered office.

10.6 If a delivery is delayed by any event outside of our control (e.g. bad weather conditions, strikes, etc) we will contact you as soon as possible to let you know, and we will endeavour to minimise the effect of the delay.

10.7 As proof of delivery, you may be required to show proof of identity and sign for your package.

11. ORDERING AND RESALE POLICY

We reserve the right to refuse or cancel any order placed with us, including where pricing or stock information is incorrect or where we reasonably suspect the purchase is intended for resale. All purchases are for personal use only, and we do not permit bulk buying or resale of our products without prior written consent. In the event of a pricing error, stock issue, or suspected misuse, we reserve the right to limit quantities, cancel orders, or refund payments at our discretion.

14. INTELLECTUAL PROPERTY RIGHTS

14.2 Your use of the Site and its contents grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to the Content (as described in the Content section below), including all HTML and other code contained in this Site. All such Content including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this Site are protected by national intellectual property and other laws and international treaty provisions. For this reason, and where the intellectual creator (photographer, animator, etc) of the above-mentioned feels that they have been insulted by the aforementioned actions of the Company, the latter will immediately proceed to withdraw the product in question.

The Company actively participates in Social Media (i.e. Facebook, X, Instagram, Pinterest, Google+). In order to browse the Company’s Social Media accounts, you will need to consent to the relevant terms of use. 17. APPLICABLE LAW
